Terms of Service

1. Introduction

IslandHub Technologies Ltd. ("IslandHub", "we", "our", or "us") is a company incorporated, licensed and operating in the Cayman Islands. IslandHub operates an online marketplace platform that connects independent sellers ("Merchants") with customers ("Users") in the Cayman Islands.

By accessing or using the platform at islandhub.ky, Users agree to be bound by these Terms of Service.

2. Nature of the Platform

IslandHub operates solely as a technology platform facilitating the listing, discovery, and purchase of goods offered by independent Merchants.

IslandHub is not the seller of goods listed on the platform and does not take ownership of inventory. All goods are offered and supplied directly by Merchants.

3. Merchant Responsibility

Merchants are solely responsible for:

• The accuracy of product listings
• Product quality and condition
• Fulfillment of orders
• Compliance with applicable laws and regulations

IslandHub does not guarantee the quality, safety, or legality of items listed by Merchants.

4. Orders and Payment

All payments made through the platform are processed via integrated payment providers, including Cayman Gateway Ltd.

Customers submit orders through the platform, which remain pending until accepted by the Merchant. Customers are charged only after the Merchant confirms acceptance of the order. Orders not accepted by the Merchant are cancelled and no payment is processed.

IslandHub facilitates payment processing through integrated payment providers in connection with transactions between Users and Merchants.

Transaction currency will be displayed to customers prior to completing a purchase.

5. Delivery

Delivery services are facilitated through third-party providers, including integrated partners such as Bento, where available.

Delivery timelines, availability, and execution may vary depending on the Merchant and delivery provider. IslandHub does not guarantee delivery performance but will provide reasonable support in resolving issues.

6. Refunds and Disputes

IslandHub processes refunds on behalf of Merchants in accordance with its Refunds and Returns Policy.

Refunds may be issued in cases including, but not limited to:

• Missing items
• Incorrect items
• Orders not received

While IslandHub facilitates the refund process, Merchants remain financially responsible for all refunded transactions.

IslandHub reserves the right to investigate and determine the outcome of disputes at its discretion, acting reasonably and in good faith.

7. Transaction Limits

IslandHub may impose transaction limits from time to time based on risk management considerations.

8. Transaction Liability

To the fullest extent permitted by law, IslandHub shall not be liable for:

• The actions or omissions of Merchants
• Product defects or misrepresentations
• Delivery delays or failures caused by third-party providers

IslandHub's liability is limited to the amount of fees received in connection with the relevant transaction.

9. Acceptable Use

Users and Merchants agree not to:

• List prohibited or illegal items
• Engage in fraudulent or deceptive practices
• Misuse the platform or payment systems

IslandHub reserves the right to suspend or terminate accounts for violations.

10. Modifications

IslandHub may update these Terms from time to time. Continued use of the platform constitutes acceptance of updated Terms.

11. Governing Law

These Terms shall be governed by the laws of the Cayman Islands.
